GENERAL REGULATIONS at “DIAMENT CLUB” (hereinafter also referred to as “Club”)
- “DIAMENT CLUB” is an integral part of a designated area located on the 5th floor of Skarbek Gallery in Katowice at 4 Mickiewicza Street.
- Persons wishing to stay on the Club premises and use the offered services are required to read these Regulations before entering. Entering the premises constitutes acceptance of these Regulations.
- The Club is available to:
- Individuals who are 18 years or older – independently and at their own responsibility,
- Individuals who are 15 years or older – under the supervision of an adult and at their responsibility,
- Individuals under 15 years of age – only under the supervision of parents or other legal guardians at their responsibility.
- The following are strictly prohibited on the Club premises:
- Bringing food and beverages, including alcoholic drinks
- Smoking tobacco products, electronic cigarettes, and IQOS – except in designated areas,
- Bringing animals,
- Bringing glass containers,
- Bringing weapons, sharp tools, and other dangerous objects,
- Bringing intoxicants,
- Entering areas designated for staff only (including: behind the reception and bar counters, kitchen, machine room, storage),
- Climbing on structural elements,
- Touching and tampering with devices, both manual and electric,
- Damaging equipment, devices, and greenery,
- Indecent behavior, or behavior considered socially inappropriate or offensive, or any behavior disturbing other clients’ use of the Club.
- The elevators (lifts) can be used by a maximum of 6 people (max. 750kg). Failure to comply with the person limit may cause a malfunction or blockage (emergency brake) and the need to call for service. Causing such issues may result in the person responsible being charged with all costs related to the malfunction/blockage.
- To ensure peace and comfort for clients and guests, Club staff have the right to refuse entry to individuals whose behavior or attire does not meet the Club’s standards.
- To ensure peace and comfort for clients and guests, Club staff have the right to refuse entry to individuals who are, or suspected to be, under the influence of alcohol, intoxicants, or other similar substances.
- Club staff have the right to refuse entry if the number of guests in the Club reaches its maximum capacity.
- Club staff have the right to refuse to sell or serve alcoholic beverages to intoxicated individuals.
- Club clients are required to comply with the instructions of the Club staff.
- Club staff have the right to ask clients to leave the Club if they:
- Do not follow the instructions of the Club staff,
- Do not comply with the Club’s regulations, including the billiard area and bowling area regulations,
- Disturb order in the Club and hinder other clients’ use of the Club,
- Behave aggressively,
- Are, or there is a reasonable suspicion that they are, under the influence of alcohol, intoxicants, or other similar substances – in each case, while still being required to pay all fees for services rendered, and in the case of prior reservation of bowling lanes or billiard tables for a specified time, also for the reserved lanes or tables for the full reservation time.
- The Club operates during the hours indicated on the website https://diamentclub.pl/. Regardless of the hours indicated, the Club may close earlier according to circumstances determined by the Club Owner or Club Staff.
- The Club is divided into three zones:
- Bar area – for clients not renting a billiard table or those waiting for a billiard table, and clients not renting bowling lanes and waiting to enter the bowling area.
- Billiard area – accessible only to those who have rented a billiard table. These individuals have access to the gaming area only for the duration of the billiard table rental.
- Bowling area – accessible only to those who have rented bowling lanes. These individuals have access to the area only for the duration of the bowling lane rental.
- The Club is not responsible for personal belongings brought into the premises by clients and other guests. This includes issues of storage, loss, and damage.
- The Club premises are monitored. Clients have no claims related to this monitoring.
- Club clients acknowledge and agree to the free use of their image/voice/statements recorded during recordings in the Club, in any broadcasts created/broadcasted by broadcasters, as well as in promotional or advertising materials prepared by these entities. The free authorization mentioned above applies to multiple uses of the image/voice/statements in all fields of exploitation.
- The Club is not responsible for damages to property or personal injury within the Club and on the adjacent premises.
- The regulations may be amended at any time without prior notice of planned changes.
- All matters not regulated in the regulations are resolved by “Diament Club” sp. z o.o. based in Katowice, which reserves the right to individual decisions in this regard.
BILLIARD AREA REGULATIONS at “DIAMENT CLUB” (hereinafter also referred to as “Club”)
- Persons wishing to stay in the billiard area and use the offered services are required to read the “DIAMENT CLUB” Regulations and these billiard area regulations before entering. Making a reservation, paying for the rental of billiard tables, or entering the billiard area constitutes acceptance of these Regulations.
- During the rental of a billiard table, the client may not leave the gaming room without first settling/closing the bill.
- The person who made the reservation or paid for the game is responsible for the provided equipment and table as well as for settling the game.
- Billiard fees are regulated according to the price list posted in the Club.
- Game time is counted from the moment the light above the rented billiard table is turned on.
- Game time is calculated per second according to the current hourly rate indicated in the price list.
- The client is responsible for controlling the game time.
- Priority for table occupancy is given to those who made a prior reservation.
- To pick up a reserved billiard table, the client should arrive at the Club and report their presence to the staff no later than 5 minutes before the declared reservation time.
- If the client does not show up and report for the rented billiard table at the agreed time, as indicated above, the Club staff have the right to cancel the reservation after an additional 5 minutes from the declared reservation time. If the person reserving the billiard table informs the Club staff by phone before the planned reservation time about their delay, the Club staff may extend the waiting time for up to 10 minutes – the decision in this regard rests solely with the Club staff. Email or message notifications sent via internet portals, including email, Club fan pages (e.g., Facebook, Instagram), etc., do not constitute a delay notification unless the delay is explicitly confirmed by the Club staff in a return message.
- Each person in the billiard area is financially responsible for any damage, specifically:
- Breaking or damaging a cue – 150 PLN,
- Damaging the cloth requiring replacement – 1200 PLN,
- Damaging the cloth causing its temporary unusability, e.g., spilling a drink (even a small amount), food staining – 300 PLN,
- Damaging or losing balls (up to 3 pieces) – 200 PLN,
- Damaging or losing balls (more than 3 pieces) requiring the Club to order a new complete set – 700 PLN,
- Intentionally unleveling the table (lifting and lowering it, moving it) requiring technical service – 800 PLN,
- Permanently damaging the lamp – 500 PLN,
- Other damages to billiard tables or equipment – according to individual valuation,
- Any stains or damage to the carpet around the billiard table affecting the use of the table, including hindering its use by other Club clients – according to individual valuation,
- For damages not listed above, the Club owner will determine the compensation amount.
- Bringing food, beverages, or items that may cause damage or stains to the billiard tables is prohibited.
- In the case of receiving damaged equipment, the client is obliged to immediately notify the Club staff. If no notification of noticed damages is made, the client cannot evade financial responsibility described in the Regulations by claiming the equipment was already damaged.
- Placing items that are not billiard equipment on the tables and sitting on the tables is prohibited.
- Club staff have the right to:
- Refuse to provide a table for play to intoxicated individuals or those behaving inappropriately,
- Expel from the Club individuals who do not comply with these Regulations or disturb other users,
- Interrupt the game for individuals who do not comply with these Regulations and demand immediate settlement for the provided equipment.
- After the game, the client is obliged to return the rented equipment (balls, chalk) to the Club staff at the reception, place the cues and triangle in the designated place, settle the bill, clear the area around the table (tables, lounges), and leave the table in the condition it was provided.
- Before settling the bill, the Club staff have the right to check the condition of the billiard table, the area around the table, and the returned equipment.
- If fewer than 3 billiard tables are in use, the Club reserves the right to close earlier.
- Regardless of the situation indicated above, the Club may close earlier according to circumstances determined by the Club Owner or Club Staff.
- Access to the billiard area (i.e., the area around the billiard table along with the associated seating area) is prohibited for individuals not renting billiard tables.
- Club clients acknowledge and agree to the free use of their image/voice/statements recorded during recordings in the Club, in any broadcasts created/broadcasted by broadcasters, as well as in promotional or advertising materials prepared by these entities. The free authorization mentioned above applies to multiple uses of the image/voice/statements in all fields of exploitation.
- The Club is not responsible for damages to property or personal injury within the Club and on the adjacent premises.
- The regulations may be amended at any time without prior notice of planned changes.
- All matters not regulated in the regulations are resolved by “Diament Club” sp. z o.o. based in Katowice, which reserves the right to individual decisions in this regard.
BOWLING AREA REGULATIONS at “DIAMENT CLUB”
- General Rules
- Persons wishing to stay in the bowling area and use the offered services are required to read the “DIAMENT CLUB” Regulations and these bowling area regulations before entering. Making a reservation, including the Reservation Agreement mentioned in section IV of the Regulations, paying for lane rentals, or entering the bowling area constitutes acceptance of these Regulations.
- The bowling area is an integral part of the “Diament Club” located on the 5th floor of Skarbek Gallery, at 4 Mickiewicza Street in Katowice.
- The bowling area is open:
- From Monday to Thursday, from 10:00 AM to 12:00 AM (possibly until 1:00 AM if at least 2 bowling lanes are occupied),
- On Fridays and Saturdays, from 10:00 AM to 2:00 AM (possibly until 3:00 AM if at least 2 bowling lanes are occupied),
- On Sundays and holidays from 10:00 AM to 12:00 AM (possibly until 1:00 AM if at least 2 bowling lanes are occupied), with the provision that the opening hours on holidays and non-working days may be individually determined, in which case the change in hours will be published at least 3 days in advance on the website https://diamentclub.pl/
- Persons wishing to use the services offered in the facility are required to pay for these services according to the currently applicable price list.
- Each user of the bowling area is required to familiarize themselves with the instructions for using the individual devices used for the game before using them, and to comply with the Regulations mentioned in point 1 above and all instructions and directions from Club Personnel. In case of any doubts, questions, or danger, the person using the bowling area is obliged to immediately stop playing and call the bowling area staff.
- The following are strictly prohibited in the bowling area:
- Entering areas designated for staff only (behind the reception and bar counters, kitchen, machine room, storage),
- Climbing on structural elements,
- Touching and tampering with electrical devices,
- Entering with inappropriate footwear,
- Stepping onto the lanes,
- Consuming beverages and meals in the throwing area,
- Damaging equipment, devices, and greenery,
- The bowling area can be used by:
- Individuals who are 18 years or older – independently and at their own responsibility,
- Individuals who are 15 years or older – under the supervision of an adult and at their responsibility,
- Individuals under 15 years of age – only under the supervision of parents or other legal guardians at their responsibility.
- Organized groups of individuals under 15 years of age must have at least one supervisor per 15 participants, responsible for their charges at all times while in the bowling area. Before entering the bowling area, the group supervisor must contact the Reception staff to establish the rules for using the bowling facilities.
- Each person using the bowling area does so at their own risk and bears the associated risk of amateur sports activities.
- Individuals with unstable health conditions should use the bowling area and equipment with particular caution (or after consulting their doctor). Diament Club sp. z o.o. based in Katowice is not responsible for any adverse health effects of being in the bowling area or using the bowling facilities by the individuals mentioned above. All cuts, injuries, and deteriorations in well-being should be reported to the bowling area staff immediately.
- Wearing glasses, contact lenses, and jewelry on the hands during the game is not recommended, may be dangerous, and is done at the user’s own risk.
- To ensure safety, based on Article 3(2)(a) and (b) of the Act of 22 August 1997 on the protection of persons and property (Journal of Laws 2017, item 2213, consolidated text of 30 November 2017), based on Article 222 of the Labor Code of 26 June 1974 (Journal of Laws 2018, item 917, consolidated text of 16 May 2018) in connection with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the bowling area located in the Diament Club in Katowice is monitored by recording devices.
- Rules for Using the Bowling Area
- The person using the bowling area is responsible for complying with the Club Regulations and the bowling area regulations in Diament Club for all individuals who use the booked lanes or are present in the bowling area along with them.
- When using the bowling lanes, it is mandatory to comply with the Regulations, instructions, and information provided by the bowling area staff. Any technical problems related to the functioning of the bowling area should be immediately reported to the staff. After the booked time has ended, the table at the bowling lane and then the bowling area should be vacated.
- Before starting the game, each participant is required to change into bowling shoes – that is, specialized shoes designed for bowling, which can be obtained free of charge at the Club Reception for the duration of the game. Diament Club sp. z o.o. based in Katowice is not responsible for bodily injuries or any health damage associated with being on the premises without specialized footwear.
- Leaving the Club, whether temporarily or permanently, in bowling shoes is prohibited.
- Personal belongings should be taken to the lanes, and own footwear should be left on the shelf provided in the bowling area. Diament Club sp. z o.o. is not responsible for the loss or damage of property left on the shelves, at the lanes, or in the bowling area.
- The use of private bowling balls or shoes is allowed only after notifying the bowling area staff and receiving their approval. Regardless, using private bowling balls or shoes is at the client’s own risk and responsibility. The bowling area is not responsible for the loss or destruction of clients’ bowling balls or shoes. The client is fully responsible for any damage resulting from the use of their own bowling balls or shoes.
- Up to 6 people can play and be present at one lane. Individuals unfamiliar with the game rules are required to ask the bowling area staff for assistance.
- The player is required to choose a ball appropriate to the size of their hand. Balls weighing 6lbs and 7lbs are intended only for children, adults may use balls weighing 8lbs or more. Diament Club is not responsible for injuries resulting from non-compliance with the above requirements.
- Only one player is allowed in the run-up area at a time.
- Each throw should be made with only one ball at a time. Throwing two or more balls in a single throw is prohibited. If a ball stops on the lane, players must inform the staff immediately.
- The following are strictly prohibited during bowling:
- Throwing more than one ball onto the lane at a time,
- Throwing a ball onto an unprepared lane (lowered barrier/sweep), a lane in failure mode (screen message), or a turned-off lane (lights off above the pins),
- Pressing any buttons on the ball return machine,
- Intoxicated individuals being in the run-up area and playing,
- Leaving shoes or clothing in the run-up area, on the player terminal, or on the ball return cover,
- Sitting on tables, ball returns, and other devices.
- Equipment failures indicated by the LED screen above the lane must be reported immediately to the Club staff, particularly to the bowling area staff at the reception. Any irregularities and failures not indicated by the LED screen above the lane should be reported immediately to the Reception. In case of equipment failure, throwing is strictly prohibited. Entering the lane to fix issues independently is prohibited.
- Fees, Penalties, Responsibility for Damages
- Fees for using the bowling lanes are charged per hour started, separately for each lane, according to the rates and price list available at the Diament Club reception and on the Club’s website.
- Individuals using the bowling area services are required to familiarize themselves with the price list applicable to the bowling area before starting the game, and by making a lane reservation or starting the game, they accept it.
- Individuals using the bowling area services are required to pay for lane rentals in advance unless other arrangements are made based on individual agreements, including the Reservation Agreement.
- In case of violation of these Regulations, the person responsible is required to cover the full damage resulting from the violation (damage and lost benefits) or pay the penalty specified in section 5.
- For violation of the Regulations, Diament Club may charge the violator with, among other things, the following penalties:
- Damage to shoes – 250.00 PLN
- Damage to a ball – 300.00 PLN
- Damage to children’s bumpers (first section) – 1,000.00 PLN
- Damage to the ball return cover – 2,500.00 PLN
- Damage to the wide foul cover – 1,000.00 PLN
- Damage to the thin foul cover – 600.00 PLN
- Damage to laminate – according to individual valuation
- Damage to the tablet/controller for managing the game – according to individual valuation
- Other damages – according to individual valuation.
- The penalties indicated in section 5 above are cumulative.
- In case of violation, the lane will be disabled, and the person required to pay compensation or a penalty must immediately settle it with Diament Club.
- For damages requiring individual valuation, the person responsible for payment agrees to pay a deposit of 500.00 PLN to Diament Club. The deposit will be settled with the actual amount due. In the case of underpayment, the responsible person will pay the remaining amount, while in the case of overpayment, the unused portion of the deposit will be refunded.
- If damages can be repaired on-site by the bowling area staff within 3 hours, the repair time will be added to the game time purchased by the client. For repairs exceeding 3 hours, Diament Club is entitled to claim compensation for lost benefits.
- Regardless of the provisions above, a charge of 100% of the value of the equipment applies for the destruction or loss of items belonging to the facility.
- Diament Club is not responsible for lost or left items and money on the premises.
- Diament Club is not responsible for accidents caused by non-compliance with the facility’s regulations, instructions, or staff directions.
- Lane Reservations
- Lanes can be reserved in person at the Reception, by phone at 518144143, 518143144, or by email at biuro@diamentclub.pl.
- For lane reservations, clients should arrive at the Reception at least 10 minutes before the game starts. After 10 minutes from the agreed time, the reservation will be canceled, the lanes may be rented, and the reserving party will be obliged to pay as if using the lanes.
- For reservations of 2 or more lanes, the Club has the right to enter into a Reservation Agreement with the Client, detailing the reservation conditions, methods, and cancellation deadlines.
- The basis for making a reservation is a clearly signed and returned Reservation Agreement to the email address biuro@diamentclub.pl within 2 days from the date of receipt.
- If the signed agreement is not returned within the specified period, the reservation will be considered canceled.
- The client may cancel a reservation under the conditions and within the deadlines specified in these Regulations and each time in the Reservation Agreement.
- If the bowling area is notified of a delay and the reservation is maintained, the fee will be charged from the reservation time, not from the actual start of the game.
- Reservation Cancellation
- The client, unless the Reservation Agreement states otherwise, is entitled to cancel the reservation:
- More than 8 days before the reservation date – free of charge
- Less than 8 days but no more than 4 days before the reservation date – subject to the obligation to pay 50% of the lane rental fee according to the reservation
- Less than 4 days before the reservation date – subject to the obligation to pay 100% of the lane rental fee according to the reservation.
- Cancellation information must be sent exclusively by email to biuro@diamentclub.pl. Information sent in another form or after the deadlines specified in section 1 will be considered ineffective, causing the obligation to pay as if using the lanes.
- In case of ineffective cancellation or failure to show up at the reservation time, the client agrees to pay 100% of the lane rental fee within 7 days from the reservation date.
- The bowling area reserves the right to refuse future reservations if the client has outstanding payments for previous reservations.
- Complaints
- Complaints related to the services provided by Diament Club and other complaints related to the operation of the bowling area can be submitted by the client in the following ways:
- In person at the Diament Club reception,
- In writing to the address: “DIAMENT CLUB” SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ ul. Mickiewicza 4, 40-092 Katowice
- Electronically via email to: biuro@diamentclub.pl
- To expedite the processing of the complaint, it is recommended to include in the description of the complaint: information and circumstances regarding the subject of the complaint, in particular the type and date of the defect or irregularity, the request, and contact details of the complainant, as well as photographic or video documentation. The requirements mentioned in the previous sentence are only recommendations and do not affect the effectiveness of complaints submitted without the recommended description.
- Complaints will be processed promptly, no later than within 14 days from the date of effective submission.
- GDPR
- In accordance with Article 13(1) and (2) of the General Data Protection Regulation of April 27, 2016 (GDPR), we inform you that:
- The administrator of your personal data is “DIAMENT CLUB” SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ ul. Mickiewicza 4, 40-092 Katowice, hereinafter referred to as the Company,
- Contact for data protection matters: biuro@diamentclub.pl
- Your personal data will be processed to execute or enter into an agreement, based on Article 6(1)(b) GDPR, or due to the legitimate interest of the Administrator (security reasons),
- The recipients of the personal data are all entities to whom the transfer of these data is necessary for fulfilling contractual obligations, including, in particular, the reception staff of Diament Club, accounting service, IT service, legal service, and if necessary, other employees and associates of the Administrator,
- Your personal data will not be transferred to a third country,
- Your personal data will be stored until the expiration of potential claims from the agreement,
- You have the right to access your data and the right to rectify, delete, limit processing, the right to transfer data, and the right to object; the above requests should be addressed to the Administrator at: biuro@diamentclub.pl
- You have the right to lodge a complaint with the supervisory authority – the President of the Personal Data Protection Office if you believe that the processing of your personal data violates the provisions of the General Data Protection Regulation of April 27, 2016 (GDPR),
- Providing your personal data is voluntary, but it is necessary for entering into the agreement,
- Your data will not be processed in an automated manner, including profiling.
- FINAL PROVISIONS
- The regulations may be changed at any time without prior notice of planned changes.
- All matters not regulated by the regulations are decided by “Diament Club” sp. z o.o. based in Katowice, which reserves the right to make individual decisions in this regard.
